Adoption visa (subclass 102)
The adoption visa (subclass 102) allows children to live in Australia who has been adopted or adopted by an Australian citizen, a permanent resident of Australia, or a qualified New Zealander. Usually, the adoptive parent applies for the child and is responsible for obtaining sponsorship.
Eligibility of Child Visa (subclass 802)
An adoptive parent can only apply for the child adoption visa in Australia if the child is:
- Below 18 years of age.
- Single and under 18 (but not adopted)
- If a child is between 18 to 25 years of age, they should be full-time students to be eligible.
- A child who is over 18 years of age and cannot work due to a physical disability and is dependent on the sponsoring parent.
- Meets the basic health and character requirements.
- It has evidence for assurance of support.
- Should be 18 years old or more.
- Should be the child’s adoptive or prospective adoptive parent.
- Should be either an Australian citizen, holder of a permanent resident visa, or an eligible New Zealand citizen.
- Should have adopted or followed the process of adopting a child with the involvement of an Australian state or territory adoption.
- Should have adopted the child under the laws of the home country (except Australia) and been living outside of Australia for the last 12 months when you apply for this visa.
- Must be a parent, stepfather, or adoptive parent of the child
- Must be an adoptive parent who adopted the child before becoming an Australian citizen
- Should have adopted or followed the process of adopting a child with the involvement of an Australian state or territory adoption.
